Bar Harbor Yacht Club Privacy Policy

WWW.BARHARBORYACHTCLUB.COM (the "Site") is owned and operated by the Bar Harbor Yacht Club ("BHYC"). The purpose of this privacy policy ("Privacy Policy") is to inform users of our Site the following:
- The personal data we will collect
- Use of collected data
- Who has access to the data collected
- The rights of Site users
This Privacy Policy applies in addition to the rules, terms, and conditions of our Site and Club Membership. By using our Site as members of the BHYC, users agree their consent to:
- The conditions set out in this Privacy Policy; and
- The collection use, and retention of the data listed in this Privacy Policy.
Personal Data We Collect:
We only collect data that helps us achieve the purpose we set out in this Privacy Policy. We will not collect any additional data beyond the data listed below without notifying you first. We may also collect username login data when or as users log in to the Site. This data may be collected and stored for an indefinite period of time by the servers and systems in system logs which are used for ensuring authorized access to the Site as well as preventing unauthorized access by non-members.
Data collected on our Site will only be used for the purposes specified in this Privacy Policy or indicated on the relevant pages of our Site. We will not use your data beyond what we disclose in this Privacy Policy. The data we collect when the user performs certain functions may be used for verification that only authorized users are logging into the Site.
User profiles during the application process are shared with Board Directors and Flag Officers as well as participants in the membership committee. By default, certain of the profile information will be shared with other active members in the BHYC. See Opt-Out section below.
Additionally, we may disclose user profile data to any duly elected or appointed board member of our organization who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy.
Other Disclosures
We will not sell or share your data with other third parties, except in the following cases:
- If the law requires it
- If it is required for any legal proceeding and
- To prove or protect our legal rights
If you follow hyperlinks from our Site to another Site, please note that we are not responsible for and have no control over their privacy policies and practices.
User data will be stored until the purpose the data was collected for has been achieved. You will be notified if your data is kept for longer than this period.
In order to protect your security we use the strongest available browser encryption. All data is only accessible to Members and/or Board Directors and Flag Officers. While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical. BHYC officers, directors, and/or members will at no time have access to or be able to capture or store credit card or other financial information of users of the Site. All transactions are performed at secure third party sites and are fully disclosed to the purchaser at the time of any online transaction.
Children
We do not knowingly collect or use personal data from children under 18 years of age. If we learn that we have collected personal data from a child under 18 years of age, the personal data will be deleted as soon as possible.
How to Access, Modify, Delete or Challenge the Data Collected
Each BHYC member is able to update their user profile page which contains all data stored for each member and is fully editable by each member except for user names. A member who is leaving the club may request his or her profile be deleted. BHYC retains expired or inactive member profile data as it is common practice for members to be reactivated after a period of non-membership.

In addition to the method(s) described in the How to Access, Modify, Delete, or Challenge the Data Collected section, we provide the following specific opt-out methods for the forms of collection, use or disclosure of your personal data specified below:
- By default, each new member has certain of their profile information visible to other BHYC logged in members via the Membership List. Any member can opt-out of visibility on this Listing using the opt-out checkbox in the profile editor
